Found this hole in attic wall. It is a townhouse unit. Is a firewall required? How would you write it up?

I wouldn't ever try to determine IF a firewall is required or not. Some jurisdictions only require a firewall to extend through the attic to the roof between every 4 units. I'd just report if a firewall is absent or if it exists between your client's unit and his neighbors.

This does exist between the two units which means its considered a firewall. Is it defective because of the hole?

I'd guess so, but not say so. Again, I wouldn't determine defectiveness. I'd report that there is a hole in the firewall between the units. Observe, report, stop.
