Uh, no.... you wasted everyone's time claiming that you had a way to predict that a vendor would go out out of business one day in the future.

You said that InterNACHI should do its "due diligence" on every vendor.

But then were totally unable to explain what it is you wanted us to do.

Let us know if you come up with something or if you were just blabbin'.

Ok son. If you can show me the post where I said I could predict business failure, then I'll concur with you. Until then, go spin yourself into a corner and wait for a newbie to come walking into your web.

I've explained plenty, and everything I've explained can be read. I'm done with the back and forth about this, as you showed us your logic is no logic at all.

Oh, and thank you for removing my affiliation. Honestly, I am relieved.

In post # 88 of this thread, regarding the vendor that went out of business, you said that you expect InterNACHI to perform due diligence to prevent it. Here is your quote:

So here is the actual post, and I still don't see where I said we should predict a business closing its doors. Do you take me for such a fool that I expect to foresee such a thing? I would expect that of no one. Like I said, everything I asked for is posted. IBS was not up and running when you allowed them to pitch to us, and yes, I think you should have been aware of that. If you don't, so be it. At least some people will see by your posts here who you look out for, and who you don't.

Its not so great if the over-the-phone "expert" misinterprets the crack for whatever reason, the seller gets peeved, hires their own SE to review it, finds it to be ok and then the seller turns around and sues you for their financial losses (losing the sale, paying the SE, legal expenses) stemming from your negligent assessment of it ...

Uh, no. The seller would have what is called "no standing" in a suit against an inspector because the seller isn't the inspector's client.

We deal with this on a regular basis (where the seller is not happy with the buyer's inspector). Probably twice a week.

Basically, a buyer is free to purchase incorrect advice from an inspector or engineer and the seller can't do much about it, other than hire his/her own experts. An inspector has a duty to his/her client.... not anyone else.

Duty is one of the 4 things you need to prove to win a negligence suit against an inspector (and you have to prove all 4). An inspector working for a buyer has no duty to to the seller to be correct.

Well, I combine 2 and 3, and sum it up for inspectors as:

1. Duty. The plaintiff has to prove that they were your inspection client.
2. The inspector had to have been negligent in performing the inspection and the plaintiff has to prove this (very tough).
3. The negligence had to have lead to the damages and the plaintiff has to prove this. So an inspector reporting that the furnace is fine when it was not, does not lead to a negligence argument over a roof.
4. The plaintiff has to prove the amount of the damages ($$$).

The plaintiff has to prove all 4.

Guys,

I think Joe F. stated it best. I as long as I own a home inspection biz, I will never call in a crack to someone who's probably on crack?

I will document the crack(s) in the inspection report, use my brain and better judgment, and make recommendations accordingly. One recommendation, which is rarely used in our area, a structural engineer.

I'm not sure where this is going, along with 80% of these strange other useless products/benefits being thrown out there lately.... With that said, it also means I do not have to partake in the nonsense right?

I also know that things are really, really bad out there in my area right now. I talk with about 20 or so inspectors all over Georgia and other states (who never visit this message board, as only about 200 ever do) and I can say things are going to get so ugly that this business as we know it will never be the same. Matter of fact the game has already changed. Time to lick my wounds and regroup.
