Default Shocking shower

I was not on a inspection but recaulking this shower. Light switch above curb and shower control right around corner I could easily touch both. Home owner was told it was o.k. because on GFI. In city with permits and inspected. If I was inspecting would this be a defect even if electrical inspector says o.k.?

The pictures are too small, but if they're outside of the enclosure, and not in a manufactured home, there are no issues. . .
