As a result of some feedback I got at the convention I would like to add one sentence to the standard NACHI Contract:
“Unless other wise indicated below, CLIENT understands that INSPECTOR will not test for compliance with applicable building codes or for the presence of potential dangers arising from asbestos, lead paint, formaldehyde, molds, soil contamination, and other environmental hazards or violations.”
*I know that our contract refers to the NACHI standards on the webite, but it can’t hurt to have this language in the contract itself. I have attached a version that contains this langauage. *
I have also added language that says the agreement is not transferrable.
After reading Keith’s book “To Inspect and Protect” I saw where he
recommends a pro-active approach and tells his Clients to go ahead
and get all the other inspections that are outside of the normal SOP…
to ensure that no one can say they were never told.
This is the recommendation I put on every report:
NOTE: The Client should provide for personal safety and health concerns by
seeking further inspections, to verify possible risk that are outside the scope of
this inspection. This company does not inspect for fungi, mold, asbestos, lead,
pollutants, radon, environmental, biological, indoor air quality, hazardous
substances-conditions, or compliance with codes and restrictions. Be advised
that everyone’s health and safety concerns are a personal responsibility and it
is recommended that further inspection be done, by qualified Professionals, to
ensure that this property is safe and healthy for everyone. These limitations are
in compliance with Texas Real Estate Commission standards of practice
John, do you use anything special or will you use anything special with regards to the camera and your use of it in your inspections within your contract or are you using it as a tag along right now.
Since the Client sees my thermal camera in use, then I make this
statement with every report…
NOTE: Although Infrared Thermal Imaging is a far better diagnostic tool
than the naked eye, it does not guarantee 100% accuracy, unless removal
or destruction of components can be achieved to validate findings. When
possible, other tools are used to verify Thermal Images, but even with these
considerations we do not claim to have x-ray vision. Conditions may
change and cause the temperature readings revealed on Thermal Images
to be different at any given time.
