In this instance, it is clear that the ESOP Committee has no jurisdiction or authority over the actions of one who is not a member of InterNACHI and, accordingly, has not agreed to abide by the COE.

Thus...it is impossible for the ESOP Committee to act in any matter that involves only a non-member, which this moderation policy has limited itself to.

When a member of InterNACHI has used the message board in an act that violates the Code of Ethics, then a complaint can be filed and it will be addressed. What a non-member does that is unethical or otherwise violates message board rules is between he and those who operate the message board.
IMO- of course

Until the ESOP has written and formal guidelines which are backed and governed with "By-laws" you (James Bushart) absolutely have no business making any such statements. You are spinning your head around your shoulders until such By-Laws are written and in place.

Times are changing and the ESOP needs changing as well. I can no longer be apart of the "old way" per say.

Like I said in the beginning, In my opinion of course.

Nothing needs to be written to support Jim's statement Frank. Jim's statement is based on rules that are currently in force.

It's surprising to me to learn that you had no interest in that thread Chris.

After Tafeens initial contact, and before I engaged with Tafeen (who claimed to represent INACHI), I contated Nick via email and he confirmed that Tafeen was representing INACHI. I was not yet aware of Tafeens status as a convicted felon. If what you say is true, why did Nick not explain that to me when I asked him if Tafeen was representing INACH?

I have an email forwarded to me where Nick states he is building a competing email newsletter product. Based on the spin you have outlined above, I suppose how it will work is that Tafeen will be associated with the competing email newsletter so that Nick can keep at arms length. Tafeen and Pro-Lab will be a Platinum INACHI Vendor who will pay Nick $10,000 for the priviledge (wink, wink) and the proceeds from the product will be routed through Pro-Lab and back to Nick.

How far off am I.
I'm surprised this hasn't been deleted yet.

So, as of now, the ESOP has no written and formal guidelines or by-laws?

I coordinated my post, by phone, with the Chairman of the ESOP Committee, who agreed with my interpretations.

If you can no longer be a part of it...well...this will have to be a personal decision on your part, Frank.

John,

I contacted you via e-mail because I did not want public spin to affect a conversation about an issue that I would like to see resolved. I understand that you feel as though you've been unfairly treated, and I hoped to help. I'm sorry that you'd rather accuse InterNACHI publicly than come to a real resolution. Please e-mail me if you change your mind.

Regards,

We do. It is called the InterNACHI Code of Ethics. We are governed by it, limited to it, and act in accordance with it in a manner that has served InterNACHI and made ours the first and longest continuing active committee in the association.

John, Everyone in the world (including you and me), member or non-member, is free to develop and roll-out any competing product or service, to any existing product or service in the world.

Did you not know that?

We have a major difference. Chris has promised that posts by members will not be deleted. With that in effect, there is increased hope of resolution to the issues instead of simply hiding them.

Let's see how this develops.

Competition is one thing, competing against your associates is quite another. Especially since you are the executive director of this association. An associate of yours does not deserve to have a convicted felon come knocking on his door with threats in the name of INACHI. The way a man handle his associations speaks volumes about his character. You and I, have differing standards of morality it would appear.

Your simple question, while patronizing, reveals a lack of knowledge of the subject.

John,

Do you go to someone with a product and demand 10K or else you'll compete against them? Or, do you decide someone has a product that you can do better at and make much more than 10k by doing it better?

I thought so!

I will not be a part of any committee that you serve on.

Look at you right now James, you are running around here starting new threads and making posts like a little kid on a play ground yelling "look at me" "look at me".
