I stand corrected.
The article is talking about Sellers hiring a home inspector. The principle still applies. If the seller is offered a free inspection with a hook in it then there is an ethical problem. The repair company uses inspectors to "get their foot in the door". The repair company uses realtors to promote the idea to the seller. The front men are feeding profit to the shadow company. The whole idea is to offer something for free so that that the inspector will get some business for the repair company. The inspector has a motive to please the one paying him and providing repeat business. The seller is placing his trust in someone who is looking to exploit his trust. The repair company will want the inspector who brings him more business. This will lead the repair company to work only with inspectors who cooperate. The realtor will encourage the seller to get something for free and is part of the pre-arranged plan for the profit of other people. The seller will recieve slanted advise. To think none of this will happen in the arrangement is intellectually dishonest. In Texas, an inspector cannot inspect a house in order to channel repair work to a repair company. There is a huge fine for that and you will loose your license. A realtor cannot make arrangements to entice a client into something that will cause kick backs for someone else. The law will punish such unethical behavior. An inspector cannot recieve payment from the same person who profits from the inspection report with a pre-arranged agreement to do this. It breeds fraud and this is why laws were made to stop this. Example: Your roof needs replaced... Oh BTW my brother in law does roof installations and he is the one paying me to generate a report that will lead you to use his services. Even if you say you will be honest... you would still be in relationship with a pre-arranged agreement to promote your brother in laws roofing business by recommending roofing repairs on your report. Next we will be wearing T-shirts with ads about our brother in laws roofing company, as we recommend roof repairs on our report. John McKenna, CMI (TREC #4565)

This suspicious type of business will not make it very far for several reasons.
1. The sellers will suspect a biased inspection will take place. 2. Sellers are done with the house, they do not want to spend money or have the trouble of supervising repairs which are often done incorrectly. 3. Profits from the repairs will not be enough to pay the inspector and the repair people adequately. 4. One unhappy seller and this will be all over the news as a scam. I would suggest any inspector doing this to make sure their state allows it and any association ethics are followed and most important: Make sure to state in the report which items need immediate repair and which ones are just cosmetic. For example, a door frame that has some slight deterioration on a 40 year old house that is in average shape. Does it really need repair? |
