Without , first, pre-defining their objectives and making them known to you, keep NACHI National out of your state and your business. Even ASHI does that for its members, for crying out loud! |

I have recived a copy of draft #2 for house bill 642. It is dated 3/7/06 and my copy does not name an author. But guess what? if this a valid document this bill is not dead as some of us we're to belive. It has no grandfather clause in it and has some tough continuing education requirements, which I don't understand because as far as I know there is no HI school in this state. I would be happy to forward this to anyone of my fellow NH members and let's start dicussing it.

When the intent is to thin out the competition, "grandfathering" clauses are omitted, for they have the opposite effect. According to his posts, Mr. Bowman has engaged in at least two conversations with Rep. Gale regarding grandfathering. Perhaps he would like to share the content of these discussions and make them a matter for record so that you can have a better idea as to NACHI's position on that topic. Peter.................I can't come close to covering the many aspects of this subject, BUT;
Peter...........I absolutely agree with what you've just stated and have strongly voiced the same during the pre-HB642 bill fight to shoot it out of the sky!!!! Concerns: Yes, it WAS dead! What happened to revive it? Done by a select few as I understand it, with an agenda!!!! I've heard and witnessed what appears to be dicission making by people who have little or no experience with NH State licensing law in general, industry experience, length of time in the business, etc. Note; State Representative Harry Gale is/was a REATOR !!!! What agenda might he have? Question: Did Harry call any of you? If so, who? In Massachusetts it is illegal for a Realtor to referr a home inspector, for good cause! The exception is a Buyer Broker. Concerning J. Bowman; Your comments; "You and everyone else are correct. The bill was defeated. But guess what. A new one is being introduced. (Yeah...they can do that)." Give me a break! Why is that? John, how did you come to be involved in NH issues? Who contacted you? Was it the majority. Having been involved in the defeat of HB642, I have seen how complex these issues can become and all hidden agendas motivating individuals. I know we all have agendas, but please, let there be open and complete awareness of meetings (open or closed) via email at least! Phone calls remind me of the stone age........basically; one at a time! By the way, last minute alerts leave us all at a disadvantage when being asked to support any agenda. We all have busy lives and NEED to know what is going on at ALL times FAR in advance! Sorry about the scattered thoughts, but there are just so many issues. I feel we in NH are under siege! By the way, I have had the feeling many times that NH inspectors have accepted the notion that we will be licensed. It's as though they've accepted defeat! WHY? Peter, I agree with your (8/9/06 4:23 PM) comments, totally! Ron Racine AppleWood Home Inspection, llc www.AppleWood-Home-Inspection.com |

Instead of struggling with an effort to convince people why they should relenquish control over their profession to the State, they argue that "this bill is less harsh than some others being suggested, so it's better to go along with it". Floridians have successfully overcome these efforts for over 15 years. Hopefully, NH inspectors can continue to win their battle, as well. I'm rooting for you. |

Thanks Ron, This is the kind of support I was hoping to see. I would also like to bring up another topic on this issue and in this new bill it states that it is being brought forward for the protection of the consumer which will by no means open a whole other topic for more discussion but when this bill came about before I called my local rep. who was familiar with bill and asked 1 how many complaints have been registered against NH HIs, 2 how many lawsuits have been to court against NH HIs, 3 out of all these complaints/lawsuits how many resulted in a decision against a NH HI. The response was there is no data to back up any reason the consumers in NH need protecting only a perception. Only a perception!!!!!! you mean that I may be put out of business because of some one's perception!!!!!!!!!! and one more thing. Most industries take into consideration a persons experience related to the field he is now working in, so this bill is telling me that my 21 years remodeling/building houses counts for nothing. Almost every house I have ever remodeled had to have had some kind of inspection prior to submitting an estimate, are the electrical systems going to be adequate, is the heating system, so on and so on.

that is what John has being trying to tell you and the others, the bill was not killed offas some prefer to believe, it just ran out of time in committee. Please look at Marcus Hutnicks letter that Frank Carrio posted in this thread, all that happened to HB642 was that much agreement and many compromises were found between the interested parties, but that it was not able to be fully agreed. As to the current draft, Harry Gale called that meeting of interested parties to continue that process, but with fewer hickups in the committee stages. Mr Carrio apparently told John Bowman that he would NOT be attending, I know marcus was on vacation and not able to attend. I have been told that the issue of grandfathering was adressed in the meeting on August 4th, as were other issues. That was the whole purpose of the meeting. You guys can make your own mind up as to why your chapter president has not ellected to keep you informed of ALL developments. Their chapter president is on the record where he stands on this legislation and has supported their efforts to defeat it. There are others, however, at NACHI National level who have not been as forthcoming. |

A year ago, NACHI was here to defend all of its members against legislation aimed at (1) putting working inspectors out of business, (2) formulating a bias toward particular associations, and (3) creating unnecessary barriers to those wanting to enter the profession. Today, their position is a secret...known only to Rep. Gale and Mr. Bowman, apparently. I think you are entitled to know. |

I have also heard that the effort to revive the bill is being strongly supported by someone who may have been promised a seat on the licensing board if it were to succeed in becoming law. While this is only a rumor and may have no factual basis, it is worth looking into. If found to be true, it should be made as public as possible so that the connection can be made obvious to anyone considering support, IMO. |
