Mark,

You should really go and read some of the 3000+ posts(that's if she hasn't deleted them) I had my had my tongue firmly implanted in my cheek when I feigned offence.

I have been cordial and non mean spirited in my communication with Wendy both public and private. That's speaking for myself of course.

Mario,
This message that Wendy posted has nothing to do with being a Home Inspector. It has all to do with people on this BBS being a professional and showing that in the postings. Professionals do not make vicious attacks against some on else.

I have read alot of Wendy's posts and I have also read alot of the vicious post against Wendy buy others. Right now I am speaking out on this because I feel that we as professionals need to stop all of this round and round attacks on this BBS. This includes Wendy, and anybody else. If you have a problem with a post? Say so with out all of the name calling and vicious attacks. Again, read the article, no where did she write that she was going to file a law suit on any body here. She is just asking that we all step up and quit making these type of attacks on the BBS.

It's raining here in Toronto nothing better to do but post and respond.The misc.Discussion board usually has nothing to do with home inspectors or home inspections,perfect example Wendy's post.

And where do you get vicious from my posts?If anyone has shown respect to Wendy it's me.

I support you in your campaign to stop the vicious attacks on anyone on this board and agree wholeheartedly that they are very unprofessional. I do not enjoy the harsh tone of so many personal vendettas being played out on this board.

That said - We should strive to be content and "agree to disagree agreeably" on a number of issues both HI related and others.

Mario, That you are and I respect you for that, and your support for Wendy on other issues. I apologize if you feel that I have singled you out. I have no intentions in doing that. I am just saying that ALL of us need to step up and clean up our postings, and quit the attacks.

I agree,We do have some sniper's here I will give you that,but the majority of posts are good humor,informative,and respectfull.

I am right there with you on your statement Mario. I think that Wendy might have either went to sleep, or she is off to her many jobs that she does. I my self hope that she re-post the article again for all to read. She does have a lot of irons in the fire. I really do not know how she does it. And I thought I had a lot of irons in the fire.

No reason to for any hurt feelings...


The original article illustrates the point how someone
offended by another person, who called her some
names, wanted to sue. (very mild names I might add
when you consider most of the internet style flames
you see).

And now a default judgement has been awarded for
$11,000,000.00 because the other person did not show
up....

Does'nt it strike you as extreme? I could not help but post
my response. I wanted to illustrate the absurd by
being adsurd.

I chose Wendy and said if she calls me a name I will sue
her because she is such a good natured and likable
person. I wanted my remarks to be tounge and cheek
to illustrate the courts rulings.

Me thinks the mentality of the law suite may lay dormant
in some of our society more than we realized. Did you
know in some locations you file a law suite with a $45
fee? Our self esteem is too fragile and hurt feelings
are the evidence of insecurity. We must learn to lighten
up a little and let it go... Relax.

I would like to say something funny here but I will refrain
myself least I provoke a torrent of preaching upon my
soul. Hold thy toungue lad.

I'll repost the article the way I originally did, without any comment. I don't have the response I originally posted to everyone.

Thank you Mark, and Mario. I got to sleep at 3:30am this morning and had to be to a friend's house at 7am to drive them an hour each way to an appointment because they don't have any other ride. Then I had to meet with the hopeful commissioner to find out he's only paying me one fourth of what was promised and then I came back here for a few minutes before taking off to do signs and drive an hour the other direction (each way) so that I can meet with the Republican Party Chairperson.

I really appreciate your comments Mark and your help. Thanks so much.

I honestly think it was a poor idea to post with my name, or anyone's name in particular. I'm sorry if I misinterpreted your post, but it does highlight my point which did include myself, about the care we need to take on the BB's.

A Florida woman has been awarded $11.3 million in a defamation lawsuit against a Louisiana woman who posted messages on the Internet accusing her of being a "crook," a "con artist" and a "fraud."
Legal analysts say the Sept. 19 award by a jury in Broward County, Fla. — first reported Friday by the Daily Business Review — represents the largest such judgment over postings on an Internet blog or message board. Lyrissa Lidsky, a University of Florida law professor who specializes in free-speech issues, calls the award "astonishing."
BEWARE OF BLOGS: Courts are asked to crack down on bloggers, websites
Lidsky says the case could represent a coming trend in court fights over online messages because the woman who won the damage award, Sue Scheff of Weston, Fla., pursued the case even though she knew the defendant, Carey Bock of Mandeville, La., has no hope of paying such an award. Bock, who had to leave her home for several months because of Hurricane Katrina, couldn't afford an attorney and didn't show up for the trial.
"What's interesting about this case is that (Scheff) was so vested in being vindicated, she was willing to pay court costs," Lidsky says. "They knew before trial that the defendant couldn't pay, so what's the point in going to the jury?"
Scheff says she wanted to make a point to those who unfairly criticize others on the Internet. "I'm sure (Bock) doesn't have $1 million, let alone $11 million, but the message is strong and clear," Scheff says. "People are using the Internet to destroy people they don't like, and you can't do that."
The dispute between the two women arose after Bock asked Scheff for help in withdrawing Bock's twin sons from a boarding school in Costa Rica. Bock had disagreed with her ex-husband over how to deal with the boys' behavior problems. Against Bock's wishes, he had sent the boys to the boarding school.
Scheff, who operates a referral service called Parents Universal Resource Experts, says she referred Bock to a consultant who helped Bock retrieve her sons. Afterward, Bock became critical of Scheff and posted negative messages about her on the Internet site Fornits.com, where parents with children in boarding schools for troubled teens confer with one another.
In 2003, Scheff sued Bock for defamation. Bock hired a lawyer, but he left the case when she no longer could afford to pay him.
When Katrina hit in August 2005, Bock's house was flooded and she moved temporarily to Texas before returning to Louisiana last June. Court papers that Scheff and her attorney David H. Pollack mailed to Bock were returned to Pollack's office in Miami.
After Bock didn't offer a defense, a Broward Circuit Court judge found in favor of Scheff. A jury then heard Scheff's arguments about damages. Pollack did not seek a specific amount for the harm he says Scheff's business suffered.
"Even with no opposing counsel and no defendant there, $11 million is a huge amount," says Pollack, adding that Scheff is considering whether to try to collect any money from Bock. "The jury determined this was a significant enough issue. It's not just somebody's feelings are hurt; it's somebody's reputation is ruined."
Bock says that when she moved back to her repaired house over the summer, she knew the trial was approaching but did not know the date. She says she doesn't have the money to pay the judgment or hire a lawyer to appeal it. She adds that if the goal of Scheff's lawsuit was to stifle what Bock says online, it worked.
"I don't feel like I can express my opinions," Bock says. "Only one side of the story was told in court. Nobody heard my side."
