Hey, guys.
Interesting story and great replies. But my take is...SUE THE BUILDER! He's the one who built the defective crawlspace access opening to begin with. He should have put a spring-loaded door, a railing and warning stripes around it. Maybe even flashing lights.
O.K., just kidding. I say do NOT put signs up, especially if there is a lawyer present. And make sure there is an ungrounded outlet just below. And a water leak. Think of it as natural selection. And one less brainless, clumsy, sue-happy lawyer.

I have in my bag Caution tape from Home depot. I he used it when I want a purchaser with kids running around to understand this si important and make a point for or about safety. Placed on the lader to the roof, and when I go into the attic. It is also available for me to use to tie off the ladder if it is windy.

We looked at "Caution" signs and "Caution" tape but the attorneys said no. "Caution" means proceed, go ahead, but with caution.

Instead, they had us use "STOP Stay Back."

Same applies in the Construction Arena Nick.
We have to use Red Danger Tape.

Caution tape, the public will still go through it and if they get hurt, we are still liable.

Correct Marcel,

Our attorney told us "Caution" is worse than nothing because "Caution" is implicit permission to climb the ladder or whatever, just do it with caution.

That's why we went with STOP: http://www.inspectoroutlet.com/stop-sign.aspx

Perhaps this explains it a little better;

Red = STOP, DANGER

Yellow = Proceed with Caution

Green = Proceed, all clear

Good Idea.

Many moons ago I received a call from a homeowner who wanted some Dormer Gables framed up.

I stopped by, put the ladder up on the 2nd floor, climbed up the ladder to take a look.

A minute or two later, guess who! The homeowner was on the roof talking to me.

I was a bit shocked to say the least. When it was time to go down, he couldn't bring himself to step around and onto the ladder. A bit of a standstill was in place and his fear was compounding of how he was to get down. Next thing I knew a third party was on the ladder coaching him down. He coached his feet onto the ladder and once the homeowner was on the ladder I said the the third party "You go down" and told the homeowner "you stay where you are at until he is down" The weight thing...Situation worked out and the fire department didn't have to come that day.

Anyway, there was no injury, but I've not soon forgotten and have made sure to make clear who is going up (me) and who is not (anyone else).

I wonder how many other professions, cable, Telephone and so on who are impacted by this.
