I am sure Nick will keep us all informed but the DBPR will add you to the newsletters list and email you direct with new info if you go click on the home inspector info and request to be added. I got this same info today from dbpr.

I will also be in attendance at the Ft Lauderdale Meeting. We need to show a strong support if this is to happen. Our greatest achivement would be being grandfathered in.

So, Nick; you are going to Florida. Why didn't you come to Kansas? We have the worst law in the nation. I cannot register in Kansas and give up my fifth amemdment rights. I will continue to be a home inspector through the January 1, 2010 deadline. They can come and get me. Licensing laws in all states are a joke, and favor only special interest groups. Why be a member of any orginization when you have to abide by state (ASHI) laws, most of which are unconstitutional? If cap and trade goes through, we will all be working for the government, at $12.71 per hour. I have tried to be quiet.

Gary....

Please make a formal request to Joe Farsetta, the Chairman of the NACHI Ethics Committee and request from him a variance to the COE that requires you to comply with your state law...particularly, those sections of your poorly written law that conflicts with your rights as an American citizen.

Then, communicate to your legislators and local media that the largest home inspector association in the nation has granted such a variance for the reason stated.

Please do this today.

Gary, InterNACHI's COE 1.10 states:

Anyway, an actual agency of the State of Florida (not a Barnes-run licensing board that announced its meetings as "not open to public comment") made me an official licensing Stakeholder and invited me and all InterNACHI members to attend these meetings for the purpose of commenting publicly.

Every InterNACHI member should attend and every member planning to attend should order his/her free T-shirt from www.nachi.org/florida .

I spoke with Joe, tonight.

NACHI, by its code, has no more of a right than does the registrtion board in Kansas, to deny anyone their rights under the constitution.

No one who refuses to provide evidence against himself to a licensing or registration board who can use it to deny or revoke a license will be sanctioned for violating ethics. The individual rights that one has under the federal constitution come before any other entity.

NACHI will not encourage violating state laws and will sanction violators when appropriate.

But when the State of Washington calls an inspector and says "Hey, we think you are not obeying our advertising rules. Send me copies of all of your advertising brochures and literature so that I can see if you violated our rules or not", they can go to hell.

Likewise, if Kansas wants copies of all of Gary's inspections for 2010 to see if he possibly violated their SOP....he is not obligated to send them.
