Hi John!

Some people say tomato, some say TOMATO!

As I do not have a doctorate in Psychology I did not realize that what I have chosen to put in Bold, Italics, or to underline is considered "Harsh!!!!!!!"

I have been trained that MOST PEOPLE just "SKIM" over a document, and if you want to call their "ATTENTION" to a particular item, THEN YOU SHOULD do so in either verbage , or by the use of a VISUAL AID!


You might read and forget a lot of messages on this BB. BUT, I'LL BET YOU'LL REMEMBER THE ONE FROM THE "HARSH GUY!"

The Home Inspectors in Kansas are about to get their throats cut.

LIKE I SAID EARLIER, FEEL FREE TO USE THE "FORMAT" OR THE BASIC PREMISE OF MY LETTERS.

The current Kansas proposal, is very deceiving. With a heavy slant to one direction. Selective as to who would fall under the proposal. Mandatory E&O to the selected group, while others would slide by. It does somewhat help the inspectors that are out in the rural areas, who may at best only be able to perform less than 200 inspections on an annual basis.

The problem is that many read it as ASHI or someother unnamed organization acceptance. However, if a slanted board should come to power, those unnamed organizations will be pushed totally out of the picture and of course the controlling board organization will win all of the marbles. This proposal is very poorly written at best and could be more potentially damaging than the current Jersey Law. What is implied is not written. If any non ASHI inspector thinks that this is a fair proposal, then don't cry when you're forced out of business, or forced to join another group. It's nothing more than organizational protectionalism.

A poorly written law is worse than no law at all. Kansas inspectors, its your future. Stand up and let your voice be heard. NOW!!

The following is an email received from someone very close to this proposal.

is Bill Yanek the political affairs director for the Kansas Association of
Realtors and someone who we have developed a working relationship with over the last few years. A meeting has been set up with him on the 16th and we were able to get the hearing for HB 2807 which was scheduled for the 14th to be moved to the 19th as well. I feel confident we can work with him to stop HB 2807 and work to develop legislation to benefit our industry while protection our clients. At this time it is not necessary for you to do
any letter writing to your Representatives, but we will keep you informed.

The bill has a few problems he states. Thats a major understatement. The author is the political affairs director of KAR, the RE industry is trying to take control of the inspection industry. And take note of the scheduled reading on the 19th. Thats a Sunday. Really. And of course, do not write any letters to your State Rep. Yes, Jeff we're really standing around, holding our collective breath's waiting to hear from you.

Wake up Kansas inspectors, you know what's going to hit the fan, very soon.

Well, our ASSHI brothers have done it again, they are now taking credit for defeating this past bill (HB-2807) and not crediting inspectors that contacted thier state reps to get this thing defeated before going to the floor. I think its high time that inspectors in Kansas from all associations that truly want a fair representation of the HI's form a coalition to propose to our reps to be presented without biase. We need to protect our businesses here first before association. Hopefully when leadership is changed at KAREI (which I understand will be soon) they will wake up and understand that ASSHI ain't all its cracked up to be. Here's the latest email from the pres at KAREI regarding ASSHI committment.

"Members,
s most of you know, HB 2807 was a bill introduced by Bill Yanek of the
Kansas Association of Realtors. The bill was intended to provide
financial responsibility requirements for inspectors and place control
of
our industry under the jurisdiction of a committee of individuals
unfamiliar with our industry. A hearing was scheduled for this bill on
Tuesday the 14th, but we were able to get the hearing delayed until
Thursday the 16th to provide more time for us to mount a defense.
Leaders
from KAREI, Great Plains ASHI and Mid-West Pro ASHI were on hand to
testify
against the bill, and we were successful at preventing the bill from
coming
out of committee. We were told by the committee Chairman that he would
not
be working on the bill this year. We assured him that we would be
working
with Bill Yanek to develop language in a joint bill which would be
beneficial for consumers and for our industry. When a final draft of
the
bill is prepared will present it to the membership to vote on. Until
then, we expect no new legislation this year, but we will keep our eyes
open and let your know if any new legislation pops up.
