While the placement of an advertisement in a Real Estate publication does not create a direct conflict of interest, the placement of or payment for an advertisement must not have any promised financial benefit, including compensation, a commission or the referral of business to or by the home inspector in violation of COMAR 09.36.06.02A(2) and (3). Further, I wish to caution you that any kind of referral agreement or the failure to avoid a conflict of interest could constitute violations of Business Occupations and Professions Article, Annotated Code of Maryland, §16-701.0(a) and COMAR 09.36.06.02.
