To All,

My biggest concern is the requirement is the Professional Liability & E&O Insurances. I think this should be left up to the individual inspector. All the state is doing is again making the insurance company richer. I personally think E&O Insurrance is a big rip off. Everyone knows the horror stories of the insurrance companies settling out of court, instead of fighting some rediculas lawsuit. When people know you carry insurrance they want to sue for the smallest deal. I know a lot of you are behind this but remember the little guys. I personally think someone should work on getting this section of it scatched from the requirements. I think the state and loosing a license over the drastic mistakes should be enough.
There is a Home Inspector that missed a big instance here in NY. The day before closing a mover fell through the floor. There was almost $60,000 worth of damage. The selller went to talk to his lawyer, was told there was nothing that could be done. The lawyer was the inspector's lawyer too. So guess what this inspector got away with it. Where was the protection for the consumers there? That is called whitewashed if you ask me.
One question to anyone will this licensing stop the favoritism of the inspectors by the Real Estate Salespeople. NO! The game will still go on! So all it is going to do is make it harder for people to get into the business.

I think many people would echo your sentiments regarding insurance. It,s a complicated issue and for now one that is not on the table for this proposed amendment.

On your question will licensing stop favoritism by Real Estate Salespeople. This bill has some provisions that may change the way inspectors are referred by agents, but no it won’t stop favoritism. And do we really want it to. I think what we want is for inspectors to be favored (referred) based on their merits. My company has several hundred agents that refer us based on our service. We earned the referrals.

I personally think it should be very difficult to get into this business. As long as the path to getting in (licensing, certification or what ever) is fair, equitable and achievable for those who are willing to work for it. Incompetent inspectors hurt the public and hence hurt the industry.

When I hear people appose high standards it makes me question their character. What are they afraid of, hard work, dedication, commitment?

Good point Dan, and likewise when I see people (like scumbag NAHI) oppose high ethics, to the point that they release 4 page papers like this, so unconscionable that states like PA have to pass laws (such as the one which is the topic of this thread) to stop scumbag NAHI... it also makes me question their character. What are they afraid of?

Nick,

When you oppose something so bad as NAHI, what is NACHI doing for the Legislation of this law in Pa. I personally think the HI in NYS did a great job of trying to help come up with a good Legislation. PA HIs should get on the board with this one too. Look at the NYS Legislation and put it to the Legislators. It works and it eliminated the foolish requirement of E&O. Which is a good choice!
