This new home has a change in color of tile for the hearth however no difference in elevation. Is this acceptable?

Tile is not flammable regardless of the color. projection of the sides appears to exceed the 1/8 inch per 1 inch rule though.

Yes, it's proper. The rule states that "the hearth extension shall be readily distinguishable from the surrounding floor."
