Default Window height and temperance

Hi Guys
Quick question about sill height. Seems to be some different opinons. If a window sill height is below 36" but it is not in a location such as stairs or landing does it need a guard and does it need to be tempered ? The window in question was about 2' feet from the floor in a dining room

There are a variety of contingencies and your description is incomplete. Refer to IRC 2006, Section 308, with your question and you will find your answer.

Do all pieces of tempered glass have to be marked? I was at an inspection today with glass on the side of a staircase, about 5 different pieces and only one had the tempered glass stamp.
