Default Double Tapping Main Lugs

A home I inspected today has a spit buss panel, a sub panel and a separate main disconnect. The split buss panel main breaker (lower right on upper buss) that typically feeds the lower buss now feeds the separate sub panel. The lower buss is now fed directly from the top lugs which are double tapped to feed both the upper and lower busses. The main disconnect kills power to the entire house with one motion satisfying the 'less than six hand movements' rule. Should I call out the double tapping of the top lugs? There are other issues I will be calling out but I am unsure on this one. I always understood that the feeders shouldn't be double tapped.
