Default Required Clearance For Thru-Wall Fireplace Vent & Windows

The house I inspected yesterday had a thru-wall direct vent for the gas fireplace. The area of concern is that the vent was located on the main floor, but it was located 3 feet under a 2nd floor window single-hung window. I've included pictures of the area. The house is new construction. If anyone has any feedback it would be greatly appreciated.

Typically, the distance is 12" minimum from a window for a direct vent unit and more for mechanical draft systems. Check the manufacturer's installation instructions.
