Default I was asked by a member to post this complaint about a vendor.

Dear NACHI News,

I wanted to let you know that Bill Janis is a liar and a crook.

I am Joe Alsvary, a NACHI member# 05122092.

I tried Bill Janis' claim of $1,000 merchant credit card system for free. I spoke with Bill Many times on the phone and he lied to me many times. I read and signed the 5 pages of contract that Bill emailed me. I specifically asked Bill if there was any time commitment or cancellation fee. He said "NO". The 5 pages of contract also did not say anything about these two items, so I ordered.

Total Merchant Services sent me the credit card equipment and a welcome packet. In the packet was a 7 page contract. They actually sent me a copy of the 5 pages that I signed and faxed to Bill and an additional 2 pages that I had never seen on Total Merchant Services letterhead. These were the 2 missing pages of the contract that Bill never lets you see. Guess what is on these 2 pages a three (3) year commitment and a $295 cancellation fee. I cancelled the contract and returned the equipment to Total Merchant Services. I also have an email from them apologizing for Bill's behavior and offering to reimburse me for any time or money he caused me to loose.

I have all of Bills emails and attachments and the emails from Total Merchant Services if you are interested. I would be happy to send it to you. I also kept a copy of all of my contract documentation.

I recommend breaking your association with Bill Janis and putting a notice out to all NACHI members.

Thanks for the info.
I was looking into this for myself and my wife's retail store. I don't like being locked into anything and especially the deceptive way that you described.

I have spoken to him on the phone a couple of times..but I cannot vouch for him or against him.....he was quite helpful when I was deciding and I did not go with his system...but it wasn't anything he did or said.

The Homegauge system just works better for me as I can force payment and integrate it with my report delivery.

I just don't think it is fair that he doesn't get an opportunity to respond.

I was asked by Bill to post this....It is a letter(note) from him to the folks at Total Merchant Services...asking them to waive the complaintants cancellation fee.....

How is have 2 pages of a contract failure to market?

Always intial and number every page of a contract not iron clad but it does help.

FYI - I have personally spoken with both Joe and Bill this morning, and the misunderstanding has been resolved to both parties' satisfaction. If anyone has any questions as to said resolution, please feel free to call me at (847) 676-8424.

Mr. Janis regrets the misunderstanding, and has offered to provide all NACHI members with a full explanation of his program along with a list of personal and professional references. He can be reached directly at (847) 263-1292.

For the record, I will be asking Nick to remove this thread at his discretion, as I do not believe that there was any intentional misconduct in this case, and cooler heads have now prevailed. This request comes with the blessing of both parties involved.

Ultimate Proof that I do waive cancellation fees

Nachi,

I have been servicing Nachi since March of 2006 and have supplied Free Credit Card Machines ($1000.00 Value) to over 100 very satisfied members. I have been in Bank Card making an honest living for 10 years. Joe Alsvary of On the Level, LLC. never personally contacted me to cancel anything. If He would have I would contacted TMS like it proves here in this email that I and Joe both received from TMS. That I have the absolute power to waive any and all Cancellation fees. But Joe never contacted me but decided to write this untrue rather slanderous letter instead.

As I read the complaint, the issue is not a refusal to waive a cancellation fee. The issue is denying that one existed, providing a partial contract to represent that none existed, and waiting until that contract was signed to inform the customer of the two additional pages of the contract...where the cancellation fee and commitment to a full year of service did exist.

Sure he waived the cancellation fee. He better had for if he had continue to illegally hold a sum of over $100...in most states, it would have been a felony.

Tony, ask Bill to address the customer's claims regarding the denial of the fee in the first place, please. It would be interesting to read his take on that.

One more thing to post...Bill says everyone gets this email PRIOR to signing up....

Misunderstandings can be avoided I think.....


This is in the initial response email That I send out.

But if for some reason it doesn’t work out return it with no obligation, no four year lease, no terms, no contract, no cancellation fee and above all NO RISK. That just shows that you failed to market it and promote it, you waited for people to ask if you take credit cards. You forgot it at home or neglected to utilize it for its true financial potential. However it’s not to smart or a good business move to stop accepting credit cards once you’ve started. Why go backwards? This is a step up to the next professional level; you want to grow don’t you? Build your business and future; do not destroy it by rejecting any form of income or revenue. Let the power of Visa/MasterCard strengthen and fortify your financial business plan and solidify its monetary value. This program was designed to financially enhance your fiscal portfolio and augment your financial strategy. This should add greatly to your business success story opening different revenue streams and ports leading directly into your bank account.
