Not to belittle the situation but I spoke with Bill Janis last year about his system. He sent me all the paperwork and I reviewed it closely. Pages were all numbered and there was a cancellation fee included. Spoke to Bill about it and he provided written confirmation to waive any fees he promised. Unfortunately the system did not fully fit my needs or I would have used it.

Bill was forthright with me, answered all my questions and never hid anything. I spoke with him several times afterwards also and no issues. Possibly this situation was a misunderstanding??

Nick -

I spoke to both Joe Alsvary and Bill Janis and a mutual resolution has been reached.

Would it be possible to remove the post regarding this matter at the request of both parties?

Here is what I posted:

Hi all -

FYI - I have personally spoken with both Joe and Bill this morning, and the misunderstanding has been resolved to both parties' satisfaction. If anyone has any questions as to said resolution, please feel free to call me at (847) 676-8424.

Mr. Janis regrets the misunderstanding, and has offered to provide all NACHI members with a full explanation of his program along with a list of personal and professional references. He can be reached directly at (847) 263-1292.

For the record,
I will be asking Nick to remove this thread at his discretion, as I do not believe that there was any intentional misconduct in this case, and cooler heads have now prevailed. This request comes with the blessing of both parties involved.

Well...I gotta tell you...Nick is anti-censorship and would not post something that he did not intend to keep. Right, Nick?

And this thread has merit for several reasons.

1. It shows that NACHI, while being very friendly to its vendors, will not hesitate to hold their feet to the fire in the interest of protecting the membership.

2. It shows that NACHI members have recourse for issues with our vendors and shows our vendors a big reason why they should continue to serve the membership, honorably.

3. It shows that, in the end, Bill made it right.

Are there any untruths that need to be corrected?

I must have missed it, but in the email Bill says he sends out it says no long term commitments etc. But then it seems the initial complaint was that after signing, there IS a long term contract sent to the client which they must sign or be liable for a fine. Correct?

So it seems to me that he is talking out of both sides of his mouth?

I trust you didn't take my removal request as an advocation of "censorship," James. If so, that certainly wasn't my intent. In my original reply, I did announce that I was going to e-mail Nick with the request.

Following the needless name-calling (from both sides) and my personal, civilized phone conversations with both Joe and Bill, I based my e-mail to Nick on the opinion that the matter didn't need to be escalated into one of those messy, feces-throwing contests that we peace-loving members are sometimes forced to endure in this forum. Not that you would know anything about those.

It even serves vendors who fly below the radar... here is how:

NACHI members are much more willing to purchase from vendors they find in www.InspectorMALL.com and not just for the exclusive discounts... but ALSO because they know (sometimes unconsciously) that they have recourse should they have a complaint.

It not only keeps vendors playing honest with NACHI members... it entices members to use these vendors who have to play honest. Win-win.

Not correct from what I understand. Bill told me that he includes a waiver of cancellation fees in writing on his clients' contracts, i.e. there is no long-term commitment.

Just so you know, I spoke with Bill (again) this afternoon and he was trying to log on with a direct, written response to this very question but is having problems accessing the forum. I told him I would post it for him tomorrow if his problems continued.

In the meantime (and with all due respect), if you have a genuine interest in this discussion, please pick up the phone or drop an e-mail to Bill directly and ask him the questions you want answered. Then, at your discretion, you can always report back with your findings and opinions. Fair enough?

I know dozens of members who have been clients of Bill's for years and all are very happy.

We've had Bill as a vendor here for a long time and he always offers NACHI members good pricing and good service.

I have been a member of NACHI for two years and this is my first posting.

On January 31st I eamailed a letter to the NACHI Newsletter and to the President of NACHI explaining the experience I had with one of its vendors.

At this point I deeply regret agreeing when Nick ask me if he could post my letter to the NACHI Message Board.

I sincerely apologize to Bill Janis for any hurt I caused him. That was not my intent. My intent was to pass along information of my experience with a vendor in hopes that it would assist NACHI and its members with feedback.

Yesterday Bill thanked me by email explaining that since this posting his business from NACHI has trippled.

I can honestly say that if Bill would have clearly disclosed all of the contract from his card services company up front I might still be a customer of his.

As humans we all make mistakes and they are all forgivable.

How can Bill say that his business has tripled? This is mind bogling to me.

I downloaded his application and was all set to get two of his machines for two different businesses as soon as I read your post they went through the shredder[applications].

I'm old school. I'm of the opinion where there is smoke there is fire.

I usually base my actions [decisions] based on facts, but in this case I made an exception.
