Okay. I do have E&O and it is my insurance carrier that is requiring a binding arbitration clause.

But again, if I force my clients into arbitration (that being the only re-course if it is included in my agreement and they sign it), do I need E&O at all?

I like IAS since it's less expensive. I just need to know with certainty that IAS provides binding arbitration. If they do, and I can see in writing that they do, my E&O provider will accept them.

Darin,

We are in the process of updatng the website to clarify that the arbitration may be binding or non-binding, depending on what the parties agree to.

As to the arbitration clause, we dont care what it looks like or says. that is up to you.

As Joe says he don't care what it looks like. But I bet your insurance carrier will. Also, Allen Insurance (my insurance carrier) provided an arbitration clause that CREIA is expecting to use when they revise their agreements. Strange though it does not include California specific language. Time to call a lawyer.

here is Joe's example clause:

In the event a dispute arises between the parties to this contract, it is hereby agreed that the dispute shall be referred to Inspection Arbitration Services (www.inspectionarbitrationservice.com) for expedited mediation and arbitration in accordance with the applicable rules of mediation and arbitration as established by IAS and in effect at the time of the complaint filing. Mediation shall be attempted as the initial means of alternate dispute resolution. In the event at reaching a mediated settlement fails, then binding arbitration shall be utilized as a final means of dispute resolution. The complaining party shall be responsible for all initial costs associated with bringing an action through IAS. Mediated settlements result in partial reimbursement of fees paid to the Plaintiff. In arbitrated settlements, and in the event that the Plaintiff becomes the prevailing party, they shall be awarded all of the filing fees and related administrative costs by the Defendant. Terms of use and other rules regarding the service and fees can be found at www.inspectionarbitrationservice.com.

If you don't mind me asking how long have you been in the business and what type of coverage do you have for what cost through Allen? I'm always looking for good coverage.

In business less than a year. I am on Allen's pay-per-inspection which is not the most cost effective. The rates are posted on their website. Good people over there also.

Just perusing old posts, came across this one . . .

Talk about a great service! A couple years back, I sent some info to Joe about a complaint. It had not even begun any legal trail. Joe created a letter that was so scathing I had to throw it in the river and then stick it in the freezer before using on the whiner!

It's a masterful first art of defense.

IAS is still going strong. I laugh when I remember that particular letter. I have written many for our subscribers since then. Shooed away 3 bogus claims last month alone with well-written response letters. No further action required.

Our cost? Still just $90 a year. The cost to arbitrate a case? Still just $350, which gets ponied-up by the person bringing the action.

The cost of IAS, including arbitratiing a case, is still far less than a competing letter writing service.

The end results are generally the same...

The major difference is our clause which compells arbitration, as opposed to a traditional trial. Where cases are without merit, a well written letter may be all that is needed. If the plaintiff still insists on moving forward, they are coomppelled to arbitration. In those instances, the matter is turned over to a competent neutral.

Simple, cheap, effective...
