THE LIMITATION OF LIABILITY
[64] I also accept Mr. Burke Jones’ argument in the alternative, that in the event he is found liable for negligence, and the claim is not time-barred, that the damages in this case are limited pursuant to paragraph 13 of the contract to a sum equal to the fee paid by the claimants for the inspection report.
