Dear Mr. Wand:

The Registrar of the Ontario Association of Home Inspectors (OAHI) has notified the Appeals Committee that you have not complied with the recommendations /requirements as stated in the Appeals Committee Document - 2008-01 (OAHI Appeals Case 2008-01).

As stated in your letter from the OAHI Secretary "The decision rendered by the Appeals Committee is deemed to be the decision of the Board of Directors and shall be final, binding and conclusive of all matters dealt with as per by-law 15.6.

Therefore, your membership was terminated on October 6, 2008 as you did not comply.

We wish you the best in the future endeavors.

Dear Sirs,

Unfortunately there are discrepancies with the manner in which the hearing was conducted contrary to the established bylaws, all documented.

Therefore I have been instructed to continue to use both the OAHI logo and the designation RHI as per PR 158 until such time as OAHI refunds my $300 appeal fee, plus interest, plus gst or conducts another appeal following the well established guidelines in the current bylaws.

I suspect OAHI did not want this document to be released, but given that I am one of the parties, I felt that the truth could not be stymied.

As of this point in time repeated requests of Mr. Bottriell Treasurer of OAHI and Appeal Chair has failed to respond to repeated requests regarding the return of my appeal fee of $300 (+gst). Considering the findings you should also note that OAHI breached the requirement of its bylaws once again.

1. The bylaws clearly and unequivocally state 5 members are to make up the Appeal Panel Committee. There were only 3 hearing my appeal. Request via Registered Letter to the Secretary of OAHI seeking information with regard to Appeal Panel makeup, evidence, witness list were never acknowledged or answered. I did not have any of the required info prior to the Sept. 8/08 hearing!

2. The Appeal Panel can only dismiss the appeal, set aside the decision being appealed from whole or in part, or impose the penalties set out in clause 14.11 of the bylaws. However considering the appeal was against the BOE, there was no decision of the DPPC imposing any finds relating to section 14.11. The Appeal Panel clearly acted outside the confines of the bylaws and policies.

3. OAHI has no authority to stop any member in the Retired Category from inspecting while retired if that member is also a member of another inspection association (i.e. ASHI, National Cert. Holder, NACHI, P. Eng, Architect), and or is gainfully employed by a third party whilst retired with OAHI and conducting inspections for the third party as part of his/her employment contract.

4. For some unexplained reason other than discrimination OAHI has refused to acknowledge repeated requests for return of my appeal fee.

Why are you posting ANYTHING for someone who has been banned? There is a reason he was banned and a reason he should not have any voice on this message board. He is a non-entity on this board and should remain as such without receiving any assistance. By continuing to post his rantings, you are only enabling his conduct. I never implied Mario Emailed you the letter.......just warning him how you will use anything or tactic to improve your own position.......he's not exempt from the tactics of a CON man............ smile and call you "Brother" while stabbing you!! I guess I was "half wrong" since you only posted half of what Raymond sent you........to show your disrespect for him. The second part that I posted shows he's still a thorn in OAHI'S side since it appears they regularly operate outside the rules that they put in place to guide them as a democratic organization. Here's the governance sucks also......someone proves unsavoury practices/deceit (spin anything you can) and the thread is removed (quite a few posts removed recently). Gotta accept that in a dictatorship!!
