Exclamation Reasonable Apprehension of Bias and Vexatious Actions of OAHI

Seems OAHI his straining at the bit. On August 10, 2006 they sent me a Registered Letter. There are seven (7) letters informing me essentially that OAHI has rec'd seven (7) complaints against me all essentially stating that I stand accused of Conduct Unbecoming a Member for practicing while Retired, and using RHI and other statements which they say are Conduct Unbecoming. In the letters of August 10, 2006 I was given ten (10) days to reply or face further punitive action and that they will proceed with the original complaints. On August 18, 2006 I wrote my reply and sent it that day Registered Letter Mail.

Today I picked up another Registered Letter from OAHI informing me as per the attached document.

It seems the DPPC, and OAHI cannot count, has reasonable apprehension of bias and is being vexatious in its actions. How is possible to get a fair hearing with this sort of nonsense going on?

As you can see below I not only have the Postal stamp dating my Registered Letter as being sent on August 18, well within the ten (10) day period, (and that should be Business Days by-the-way, not just 10 days) but also have Canada Posts delivery print out to aid in my defence showing OAHI rec'd the letter on August 22! I also sent my reply of August 18, 2006 to the Association Counsel, Mr. Segal to ensure there was no Monkey business and have proof from Canada Post that the letter to Counsel was also sent August 18, 2006, and received by counsel on August 21, 2006.

Needless to say I will be replying to this latest gaff, and will be sending another copy of my reply to OAHI legal counsel Mr. Segal. I am sure he must have problems with the conduct OAHI is taking.

I am sure Claude Lawrenson will find this most disturbing, being Ethics Chair of the National Body of which OAHI is a signatory and goes hand in hand with my well voiced concerns about objectivity and fairness and reasonableness within OAHI vis-a-vis disciplining of members.

This is so unfortunate that OAHI not only does not follow their own bylaws they now show how much they are trying to railroad you .
Last time it cost about $35,000;00 with their improper treatment of me then they paid another $1,000;00 to help cover my expenses.
They are slow learners If this keeps up then I can see they are going to spend more against you and I am sure they will loose again .
If the lawyer is smart and gives them proper advice they will send you a letter apologizing for their errors .
This just gets more interesting every day .
WOW! I just can not see how they could try this they need to talk to their lawyer before this goes any further.
Gee I love it when the OAHI BOD just does not understand that things need to be done properly.
I sure hope Mr. Lloyd is good a fire fighting .
This makes me so nervious when I think this is the DPPC chair of the group who think they can run the National Certification .
Mr Lloyd should not give up his day job.

Ray a postal mark such as you have is deemed valid evidence of proof of date of delivery, to the fact that you have responded in "whatever" manner. It is my understanding that Bill M. ran into similar mail "delivery" issue, regarding membership renewal, so this comes as no big surprize. Perhaps its just an issue of tardiness, wherein the letter was not picked up. Again just noting this because Bill's renewal sat for a while in postal delivery box.

From my POV it sounds like you have responded within the set time limits.

I am not surprised Bill was treated that way. Now I understand why Bill has soured on OAHI and put his eggs in the CAHPI basket. OAHI is on thin ice with this one. It would appear they had this ditty of a letter as posted above already in the works. How they calculate 10 days is alot like the manner in which they do the bookkeeping!

Thats an understatement, I guess they will have to bring in an outside arbitrator because its apparent they have no intention of acting fairly. Someone is giving OAHI bad advice. Its amazing so far I have been threatened by more then one OAHI member, and now the DPPC Chair and his committee seem hell bent to try underhaned tactics. Well now you know why I posted this info, so you can all see how they conduct themselves. Whistle Blowers are not to be tolerated.

WHY DID THE OAHI MEMBER CROSS THE ROAD?

DR. PHIL:
The problem we have here is that this OAHI Member won't realize that he must
first deal with the problem on "THIS" side of the road before it goes after
the problem on the "OTHER SIDE" of the road. What we need to do is help him
realize how stupid he's acting by not taking on his "CURRENT" problems
before adding "NEW" problems.

OPRAH:
Well, I understand that the OAHI Member is having problems, which is why he
wants to cross this road so bad. So instead of having the OAHI Member learn from
his mistakes and take falls, which is a part of life, I'm going to give this
OAHI Member a car so that he can just drive across the road and not live his

Discipline and Professional Practices Committee


3. Upon receipt of a written complaint concerning the conduct of any member of the Association (hereinafter called a "Complaint"), the Secretary of the Committee shall forthwith upon receipt thereof, mail a copy of the Complaint to the member against whom the Complaint has been made (hereinafter called the "Respondent"). The Respondent shall, at the discretion of the Committee Chairman, be given not less than ten (10) and not more than thirty (30) days to deliver a reply
thereto in writing addressed to the Secretary (hereinafter referred as the "Reply"). Where the Committee is proceeding upon its own motion, the Chairman may in like manner, direct the Secretary to mail to the Respondent a brief statement of the conduct or infringement being investigated by the Committee and the foregoing provisions as to Reply shall be applicable and the matter shall thereafter proceed in all respects as a Complaint by any other person concerning the conduct of a
member of the Association.

4. After the time limited for the Reply, the Chairman of the Committee shall determine a date for the hearing of the Complaint and direct the Secretary to give to the Respondent notice in writing of the hearing and such notice shall be mailed by registered mail by the Secretary to the Respondent at least fifteen (15) days prior to the date fixed for the hearing.

Gee I sure hope OAHI can give me the required 15 days notice as stated above in regards to notice of a hearing. They haven't been able to reply timely to my complaints which took well over 7 months to even get a reply! I guess the 10 day requirement is only used when they feel they are owed a proper explanation immediately because they are far superior!

This far from fair and proper in My openion . Aperson could be on Vacation for three weeks and be found guilty fined and removed from the roster before he even new there was a problem
Unfortunately Bill is not the only person I have heard this happening to I know of at least two others and they both had fines and felt why should they fight it was just not worth the aggravation. .
They are so good One person received his complaint and fine amount one month before his membership had run out .
If this was not so serious a person could have a big laugh.
I wonder is this just another way of keeping the membership low .
Pi$$ the HI off and he just gives up looks so strange to me .

Its also not my fault that the reply sat in a Canada Post facility over the weekend!

I think you will find that legally, a letter post marked within the 10 day (12 midnight) requirement is legal proof the reply was responded to within the requirement of the letter.

I also know as DPPC Chair it was not uncommon during our tenure that the 10 day rule was unduly restrictive, respondents do have biz committments and families, and as mentioned some were on vaction, moving, deaths in families, et ceteras. The complaints dealing with members vs. members were given ample time to reply and certainly not within 10 days, ditto public complaints. AND we never had to hold a hearing! We were able to work with members to correct their oversites, contrary to what some would have you believe.

This is all the more reason to call for licencing. The proof is in the pudding.

I find it interesting that OAHI takes for ever,.. to respond to email inquires. It also takes them up to three months to upgrade membership status. So, how could they expect a response in ten days. It takes them that long to respond to my email! Unbelievable! Like someone said you could be warned, tried, and convicted while away from home.
