Should home sellers not be also responsible for reporting the home Condition also.
http://www.nachi.org/forum/f48/more-property-information-59011/#post788049 .
[FONT=Tahoma][size=2]Why not have the vendors carry E&O and put up a security deposit when they sell a home. I can’t see any reason why Vendor’s should be exempt from disclosure and liability!.
All the responsibility seems to fall on the Homies .
Thoughts … Roy

Bob Aaron has many good ideas .
It might be a good idea to feed him our thoughts and information …

If Bob Aaron thinks he’s seeing a lot of new court cases due to the SPIS, he would be swamped if anything like the above was in place. It’s the same reason many advise not to advertise HI E&O if you carry it…you just told the buyer there is $$$$$ to be had!!!
I can see why he’s upset/excited about the current complicated, some times ambiguous, technical Ontario SPIS. Here we’ve had a much simpler PCDS for 8-9 years now…I have never heard of a major problem with them here.
I will distribute copies of the Ontario ruling to the few realtors that I know so they can encourage their clients to be forthright with the information they provide about the house.

That’s why we should be able to charge more; the lawyers and realtors certainly do.
With the weasel clause beginning to be banned, HI’s will have to become much better and take the time necessary to do more complete and accurate inspections.
