John: Here is my advice - but only because you have asked for it !
Your predicament is in my view beyond help - because your main mistake has been to accept the assignment to carry out a termite inspection without training or expertise in the first place. Having charged and accepted a fee regardless is the final nail in your coffin. I certainly would not spend one penny on a useless lawyer as suggested by others. But I would try everything possible to settle the matter directly with the former customer by explaining that you have no insurance, and that you have - hopefully - no assets which can be liquidated to satisfy a $200.000 claim. The bottom line is that you have to convince the claimant that you have simply made a mistake and that you have no money. RUDOLF REUSSE - Home Inspector since 1976 - TORONTO |

Thanks Kevin I'm no longer collecting money for services rendered when it comes to termite inspections. It's not worth the little I make. Now can I simply advertise termites and if they call refer them to a hand full of companies and let them decide or should I stop advertising termites all together on my site?

Well said Doug.
Bill, your best bet is to tell the client that they need a ( fill in the blank ) inspection and direct them to the yellow pages. Unfortunately we can all be sued for anything by anyone and these days if you have any connection to the 'event' the lawyer representing the plaintiff will include you in his filings to the court. |

Kevin, you might have some liability because you recommended the company.
As you well know, lawyers sue every one involved in the transaction, you could have to pay some money,of course not all. Remember ,the law is not always fair, even if you are right Harry |
