E & O should not be mandatory for the very reason that Jim Bushart noted. I have an inspector in a mandatory state who had to get me to squash three ridiculous claims against him. They all went away.
Imagine if he didn't have that resource. He'd have turned those claims into his carrier. They would have caved. And he'd either be paying a punishing renewal premium or be unable to get insurance altogether and, thus, be out of business. Joseph A.
