Listed below is the veto letter from Governor Bush and the vetoed HB 315 Bill.

Now that you have REAL information to base your opinions on, I will now provide the information that transpired in Tallahassee yesterday during the DBPR meeting.

The meeting began around 9 am. Lunch break was provided. Second meeting in the afternoon.

The Head of the DBPR sought input from the industry regarding what should and what should not be included in this year's version. It is important to recognize the difference between input and changing the minds of the DBPR.

The DBPR does not want a LICENSING BILL. Please READ this AGAIN!

The DBPR wants to have a REGISTRATION Bill. That will require all complaints to fall under the trade practices act already on the books.

The MOLD portion of HB315 will be removed.

The education requirement will stay. The details of how many hours are still in discussion. The exam to be taken is still in discussion.

There are going to be three more meetings that I plan on being there for over the next three weeks.

Jerry Peck was not there. Larry Cerro from ASHI was and proposed the HI License Permit as I have posted earlier in this thread. More than half of the room was NOT in favor of this proposal including Joey Cabellero, who I had this specific discussion with prior to the meeting taking place. Thank you Joey Cabellero for seeing this the same way we do.

Mold was briefly discussed and will have its own meeting. I believe there will be an effort to have a three tiered system in place that will put limits on scope of work. For example:
1) A trained Home Inspector can take air samples, but must refer the results to a CEI for interpretation
2) The CEI does not do the remediation
3) Remediators do not do their own initial or clearance tests


The HI GL insurance requirements will stay the same. The FULL disclosure of experience or number of inspections would stay the same.

There will most likely be an addition to include Standards of Practice to follow and I believe all NATIONAL associations will be identified in the Bill. An inspector may choose what SOP to follow as long as they follow one.
There will be no requirement for an inspector to join an association. There will be an approved Training school list. The grandfathering clause is still in discussion.

To all Florida Inspectors - There will be some form of regulation in 2006. No telling when the regulation will be enacted July 2006 or January 2007, but keep in mind there will be something signed by the Governor.

Jay,

Removing the mold portion of HB 315 - with additional follow up meetings to discuss mold - indicates that the DBPR is considering drafting two separate bills to present to the legislature. Am I understanding that correctly?

Thanks.

Are the home inspection associations planning on making a large amount of input into the mold bills this time since there was none last year?

The indoor environmental lobbiests seemed to control the last measure that was added to the HI bill at the last moment. It seemed as if their input hurt quite a few home inspectors who do mold testing down thee.

There is a need to separate mold from HI. However, it is vital that Home Inspectors, with the proper training can do air sampling.

Mold does need to be separate. Any bill that does not grandfather all current home inspectors in is unfair. It would be worth a nice court challenge based on other professions.
