Hi all,
NH NB642 has now entered the house study committee, where they are
basically rewriting alot of the bill.
Thanks to all that attended the hearing and gave their imput is being passed along from our state legislators.

As soon as I get any information on the progress I will pass it along.
I have also emailed our SOP's and code of ethics to the study committee
and hope that NACHI will allow NH to model them

Completely different from 642.

Hi all,

status: there is a completely new HB 642 consisting of 7 pages.

there is no grandfather clause whin the bill and
to be eligible for a licence as a home inspector, an applicant shall fulfill the following requirements:
(a) Be of good moral character
(b) Have successfully completed high school or its equivalent
(c)Have completed a course of study of no less than 80 hours that
covers all of the following...
(d) Have acquired the required training and experience requirements
as established by the board.
with out stating it I do believe they have included our sop's and coe
in the bill which was presented to the sponsor of the bill a couple of months ago.
I only have a hard copy but I will send it to Amy and hopefully she can
get it up here for viewing.
The bill is being moved to another committee for review and time is
of the essence to get bills in for the 2006 session.

Carla,

Please take my feedback with a grain of salt. After 2000 NH inspections and witnessing how three other states conduct home inspection regulations, I hope my opinions can be heard. I am very nervous about letting 'any government' branch dictate, drive, enact into law rules and legislation that will direct home inspections in the daily business practices to perform competent and valued home inspections. I have seen the mess that Mass. and N.C. licensing has created for the not just the home inspector but also for the common person. Don't get me wrong. I believe state registration and licensing is key to promoting the home inspection industry and protecting the customer. As long as it knows it is there is help and guide and not to rule and punish.

Comments submitted by referencing HB sections (as best as possible)

329-B:1 Should the purpose also be to protect the home inspector
from erroneous and unfounded claims by the sue-happy
public and legal professions? I'm all for consumerism, but
we must make sure that this effort isn't one sided and crazy.

B:2
section 1 - OK to the term Apprentice. Should be also state in this
section the term Full Inspector?
section 2 - OK
section 3 - "Visual Analysis" may be too commital for what we
can and not do. Analysis could give the customer the
impression that a 'detailed - all inclusive - absolute' effort is
provided. I would preferred that it read "General Visual
Inspection". Remember, it's all about setting expectations and
setting those expectations early.
section 4 -.......and receives a fee.(added?)
section 5 - OK (pretty standard)
section 6 - OK

B:3 through 12 OK, but it will need to be polished up and editted
as time goes on and the State matures with this process.

B:13 - May I suggest that another State's license may not meet all
of NH Requirements. This section may need to be better
worded. Also the valid license should also be 'current'. This
whole chapter might need further discussion. To kick -off NH
licensing, it might be best to simply state that reciprocity will
be decided on within the few 1-2 years. NH needs to
understand that reciprocity is more than "I'm OK with you,
and you are OK with me". It may take into account legal
issues across state boundaries,& seeing if the other state will
accept NH licensing in return.

Additional Comments:

Carla,
Is it noted anywhere in HB642, the mandatory requirement for E & O insurance? ( I hope that it isn't).
Also, somewhere, I read that HB 642 was being drawn up by
code enforcement officials. If that is the case, we might be getting ourselves in all kinds of hot water. Code enforcement officials have a completely different objective. I wouldn't want their goals and objectives to be crossed with the purpose of a home inspection. N.C. did this several years ago and the states inspection standards of practice can be very litigious for home inspectors

THat was the PDF file I was referring to. I'm anxious to find out what happens. I know that Bob Pokorny was having a State Rep at the first NACHI meeting. Hopefully no law gets pass until we can get a piece of his attention. Too bad the first meeting is pushed out to January.

I didn't hear anything about a meeting in January, what meeting?
I imagine "the Rep" would be the one who sponsored the bill. ??

I guess I am not in the loop. Anyway, I think that the requirements
are a little much.

The code enforcement BS was in the original bill,
that has been ammended to the forming of the
licensing board and that will be the boards position.

Hi Carla:

Looks like NH wants to have one of the strictest bills in the Nation. If you have been following the Florida thread, you know my position towards licensing. I would encourage you to have a meeting with your NH colleagues and decide your fate. The Bill as a whole needs some more looking into. Perhaps Dan Osburne, the NE legislative commitee member, can point you in the right direction.

Yeah, I agree the bill is a little much!

I have been to the study meetings and hearings, the problem I
see is people don't have a clue.

Gerry B was at a hearing last year with me and he really opened
their eyes with his thoughts.

I am on the NH public policy committee and so I am very in tune
to proposed bills that effect the entire Real Estate industry in general.

We are having a forum on Dec. 1 in concord. I am planning on
bringing NACHI imput to the table again. We will hang in there
until the bill is fair for all.

Hi all,

We had a good forum meeting on thurs. alot of new friends
were made!

Unfortunately, hb642 has been passed through the committee
that was working on it. It will be sent now to the entire house
body for vote.
This is not good!!!!
We need to ALL contact our legislators ASAP to prevent the bill
from passing in the House.

I will come up with a short email based on the imput from the group
that met with items we are opposing, and our suggested changes
to those items.
PLEASE join in!!! We have over 60 members and if ALL of us email,
call or write letters maybe we can get this current bill killed before
it is too late. The report is due out Jan 4.
Please look for the email and forward it onto your legislators.

Hi all,

We are making great progress with the opposition of this bill.

I have spoken with some Reps. regarding concerns with the proposed
amended bill, and they are with us on all of it.

at this point I feel strongly that the bill will be sent back to
committee.
If you want to email your rep, search for NH general court,
click on House, then click on Representatives with email. There
you will find a list of 349 Reps email address.
