Limit liability with inspection agreement in lieu of E&O

I was looking at other home inspectors websites and I came across one where this guy was limiting any potential errors and omission damages to the cost of the home inspection by some type of damage liquidation clause in his inspector agreement . Now, doesn’t this seem like a really good idea instead of paying for errors and omissions insurance?

Hi Ray,

problem is many states require E&O coverage, and others will not allow you to write a contract that limits liability to the inspection fee.

However in many states it is acceptable and a legal contract tem, check with your lawyer in all cases

states, you can’t “contract out” negligence. Any good attorney will see this for what it is.
