Default 3 wire feed to sub panel new construction

My observation is that this should be a 4 wire feed to the sub panel and the bond screw be removed from the sub panel. Please let me know if this could be refuted and if this set up is acceptable.

Yes the bonding screw should be removed. Is that a metal raceway between the panel and the disconnect? If so that is the "4th wire' which is actually the EGC. If it's PVC then you're correct an additional conductor is required to serve as the EGC.
