I went out to re-attend an inspection I performed in August last year. This inspection was a PDI-Tarion Warranty.
One of the items identified was the fact that the builder had not installed the Foundation Waterproofing at the front of the home where the entry stairs were going to be installed at a later date. The Dela-MS was damaged in several locations around the property too.
Not only is this a Building Code violation here in Ontario, but it’s also a Construction Performance Guideline Issue. Six months on and the builder has not fixed this problem. Now my client is face with a conciliation inspection from Tarion. He is being charged $288 for the inspection, which IF Tarion don’t find anything he will get refunded.
When he queried what happened to his Tarion Warranty Premium, he was told that the Builder paid that, and he must cough up for the Inspection.

Warranty Enrolment Fees
“For freehold homes, the builder pays the warranty enrolment fee to Tarion on or before the date the building permit for the home is issued. Condominiums are enrolled at least 30 days before construction begins. Tarion then gives the builder an enrolment number for the home. Some builders will include the warranty enrolment fee in the purchase price of the home, while others show it as an item on the Statement of Adjustments.”
It’s clear that the Builder does NOT pay the Warranty, the home buyer does. This warranty is supposed to protect the home buyer. Once again it is showing that it is there to deter the Home Buyer from chasing the builder for faults and actually protects the Builder.

**I’ve recommended my client to pay for the Tarion Inspection and then let me know when the inspection is set for. I’m going to be there fore this inspection. I’ll report back on the results.
I will even pay for my Clients Tarion Inspection if they don’t find anything. Then the Sh17 will hit the fan.
