W.Va.AG Files Lawsuit Against Cabell County Home Inspector

[FONT=“Helvetica”]CHARLESTON — West Virginia Attorney General Patrick Morrisey announced thefiling of a lawsuit that seeks a court order to shut down a Cabell County homeinspection business for alleged violations of the state’s Consumer Credit and ProtectionAct.[/FONT]

The lawsuit alleges Safe & Sound Inspection Services, owned and operated byIvan Leon Harless, charged customers for water removal and/or mold remediation,but failed to complete the work or refund their payments.

“Protecting consumers against deceptive business practices is a top priorityfor my office,” Attorney General Morrisey said. “Businesses that operate withinWest Virginia are required to follow the rule of law. We will vigorouslyprosecute those who choose an unlawful path.”

The lawsuit, filed Tuesday in Cabell County Circuit Court, alleges Harlesscontinued to operate Safe & Sound Inspection Services after its statelicense was dissolved for failing to file an annual report with the WestVirginia Secretary of State’s Office in 2014.

Harless then pleaded guilty in January 2017 to obtaining goods by falsepretenses and fraudulent schemes.

The Attorney General seeks an injunction to prohibit the company or its ownerfrom engaging in future business. The lawsuit also asks for reimbursement forconsumers who were harmed by Safe & Sound business practices, court costs,investigative costs, attorneys’ fees and penalties of $5,000 for each violationof the state’s Consumer Credit and Protection Act.

Sad to hear; is not any wonder why some people question the lack of control in this sector?

Even sadder, after being dissolve by the authorities he carried on practicing. He actually got dinged for his mould remediation services rather than his inspection services.

Interesting enough this doesn’t do too well for InterNACHI. Maybe past members ought to be made to take down their InterNACHI insignia instead of tarring everyone here with negative news.

Certainly not good advertising, but lets face it he will likely not be the first or last one to mark the good work and professionalism of others.
