How to form a FORMAL CHARTERED InterNACHI Chapter (not required)

Although not required, some Chapters are evolving from informal meetings toward becoming their own separate entities.  Some of these chapters want to exist as separate entities so they can open bank accounts, collect dues, group market and so forth.  InterNACHI has established a voluntary program to help InterNACHI members establish local Chapters as separate entities that will allow the local Chapters to operate independently with tax exempt status.  Now InterNACHI members who want to form a chartered local Chapter can do it – it is easy and costs the local Chapters nothing.  InterNACHI will cover any costs related to the process.
 
Members desiring to form a chartered local Chapter should hold at least 4 informal chapter meetings first (see below) and then complete a one-page InterNACHI Application for formal chartered Chapter and submit it to InterNACHI for review.  Once the Application is approved, InterNACHI will grant a Charter to the local chapter.  Then they must form a non-profit corporation in their state and InterNACHI will assist with the formation.   In addition, InterNACHI will provide assistance with the local Chapter in setting up their bookkeeping and accounting records and will also assist the local Chapter with any Federal, State and local tax filings that might be required each year.
 
InterNACHI has already done most of the work.  InterNACHI will provide local chartered Chapters with sample model Bylaws that they can use/modify.  Local Chapters will be able to take advantage of InterNACHI’s status as a tax-exempt 501(c)(6) organization under an IRS Group Letter ruling – the local Chapters will NOT have to file a separate application for tax-exempt status with the IRS.
 
Although InterNACHI has established this program to allow for the formation of chartered local Chapters as true separate entities, InterNACHI understands that some informal groups of inspectors may not desire to incorporate; there is no requirement that these existing groups apply to InterNACHI for a charter.  Whether you seek a local Chapter charter or not, InterNACHI encourages its members to continue to meet with one another to exchange ideas and share experiences.
