InterNACHI is pleased to announce the launch of its Alternate Dispute Resolution Service
(ADRS). This unique service is a combination of Arbitration and Mediation, where
consumers contractually agree to bring claims against Home Inspectors prior to
any alternate venues. This service is unique to the Home Inspection industry,
as it is available only to InterNACHI members, through the association, and is tailored
to Home Inspection issues. It’s a win-win for Consumers and InterNACHI inspectors.
For a small annual fee, InterNACHI members can have an industry arbitrator hear, mediate,
and settle claims. The pre-set, low annual fee covers all arbitrated/mediated
cases, with no limit to the number of claims reviewed per year.
Typically, an arbitration can cost the consumer as much as $500 or more, for
starters. InterNACHI ADRS is quite different, in its low cost. A low cost option means
that a consumer is more likely to try arbitration/mediation first, rather than
launching a conventional lawsuit. Arbitration is widely recognized as a preferred
method for dispute resolution, as opposed to the cost and timing of a normal court
proceeding. For a nominal annual fee, a InterNACHI inspector can add this important
service for their Clients.
The service was packaged in a manner, which makes it quite attractive, monetarily,
to the InterNACHI inspector. Unlike pre-paid legal services, InterNACHI’s ADRS costs the
InterNACHI inspector a flat fee of $90 per year. In addition to this, a clause is inserted
into your Inspection Agreement, which obligates the Client to use InterNACHI’s ADRS
as a first step in resolving their complaint. It costs the Client a nominal fee
of $45 to file.
Cases are reviewed and mediated via the Internet, including the gathering of
statements, contracts, and other evidence. No time is lost from work for either
party. The service is efficient, effective, and reasonably priced. Alternate means
of dispute resolution help keep court calendars clear. In fact, it is so effective,
that some jurisdictions mandate that all cases with a monetary value under a reasonable
threshold be adjudicated via Arbitration and Mediation. It’s the way to go; and,
for the InterNACHI inspector, helps ensure that your case is reviewed, mediated, and
arbitrated by someone who understands the industry.
